General terms and conditions
These general terms and conditions of sale govern all relations between:
the company De Laere BVBA, with its registered office at Kerkplein 15, 1930 Zaventem, VAT BE 0466.824.277, RPR Phone number: 02 720 00 97 - Fax number: 02 725 42 51 (hereinafter "Fresh Food Point.be") and the parties who place an order via the website www.freshfoodpoint.be (hereinafter " the Consumer ").
Fresh Food Point.be offers its customers the possibility of ordering certain items and having them picked up or delivered to the professional address requested by the Consumer.
These General Terms and Conditions ("Terms and Conditions") apply to all items from the freshfoodpoint.be webshop range and to every order placed by the Consumer with De Laere BVBA via www.freshfoodpoint.be.
By ticking the box "I agree with the general terms and conditions of sale", the Consumer confirms having read these Terms and Conditions prior to any transaction and accepting them in full.
Article 1 - General special terms and conditions of sale
By placing an order via the website www.freshfoodpoint.be, the Consumer confirms to have taken cognisance of these General Terms and Conditions of Sale as well as of the special terms and conditions of sale as they appear on the screen (name, price, weight, quantity, special product characteristics, cost price of services, etc.). By placing an order you agree, as a consumer, to accept without reservation the general terms and conditions of Fresh Food Point.be - as published on the website www.freshfoodpoint.be.
Article 2 - Offer
Despite the fact that the brochures and the webshop are compiled with the greatest possible care, it is possible that the information offered is incomplete, contains material errors or is not up to date.
Fresh Food Point.be is only bound by an obligation of means as to the accuracy, topicality and completeness of the information offered. Fresh Food Point.be shall not be liable in the event of material errors, misprints or printing errors.
The offer is valid while stocks last and may be modified or withdrawn by Fresh Food Point.be at any time. Fresh Food Point.be is entitled - without giving reasons - to refuse orders, to adjust the delivery periods, to split deliveries and to attach other conditions to the delivery.
Article 3 - Ordering products or services
3.1. Online ordering
Step 1
a. Registration & login
Before proceeding to place an order, the Consumer must register in the webshop system. Registration should be done only once. On a subsequent visit, it is sufficient to log in oneself using the user name (e-mail address of the Consumer) and password that the Consumer received by e-mail as confirmation of the registration.
b. Ordering online
After going through the webshop and selecting the desired products, the Consumer places his order by clicking on the "order this shopping basket" button. If the Consumer failed to register or log in first, he can still do so in step 2.
Step 2 : Customer details
If the Consumer is correctly logged in (logged in), an overview of all customer data appears with all details of the order. If the Consumer has not yet registered or logged in, he can still fill in the necessary details here. To continue, the Consumer can click on one of the 3 green buttons below: 'continue shopping', 'back to shopping basket' or 'next step'.
Step 3 : Overview
Here the Consumer can check his details and the order. Next, the Consumer can adjust his order by clicking on the button "adjust order", choose to further automatically agree with our general sales conditions.
Step 4 :
The Consumer receives a final overview for review and confirms by clicking on the button " confirm order" after which the site connects to the Ogone secure online payment module.
Step 5 :
On the screen of Ogone's secure online payment module, the Consumer enters the necessary bank details. After completing the online payment procedure, the Consumer automatically returns to www.freshfoodpoint.be.
3.2 On-line payment system
PAY.NL systems for automatic transaction registration shall count as proof of the nature, content and date of the order. For any order worth more than €750 (all-in price of the merchandise), the Consumer must, to the exclusion of any other ordering method, print the order form on the screen and send it duly signed to De Laere BVBA, Kerkplein 15, 1930 Zaventem. A copy of these general terms and conditions of sale must be added, also duly signed by the Consumer. Failing this, any order exceeding this amount will not be taken into account and no legal force can be derived from it.
3.3 Off-line ordering
The Consumer may choose to place his order off-line. This can be done by e-mail to orders@freshfoodpoint.be or by telephone on 02 720 00 97. In both cases, the Consumer must take into account the delivery time determined for each product and the provisions set out in Article 4. of these General Terms and Conditions.
Article 4 - Confirmation of orders
4.1. On-line orders are automatically confirmed by website www.freshfoodpoint.be via an e-mail summarising the details of the on-line order.
When payment has been made in accordance with the payment method you have chosen (either online, by bank transfer or in cash at one of the shops), Fresh Food Point.be confirms the order. The sale only becomes final when the order is confirmed by Fresh Food Point .be.
On-line orders are only regarded as confirmed by the webshop system once confirmation of payment via external on-line payment module has also been completed. Fresh Food Point.be undertakes to execute all confirmed on-line orders within the specified period if they meet all the provisions of the General Terms and Conditions of Freshfoodpoint.be. If this is not possible for whatever reason, Fresh Food Point.be will contact the consumer to discuss possible alternatives.
4.2. Off-line orders by telephone or e-mail must always be confirmed by both parties by e-mail. In this e-mail all necessary details shall be mentioned, in particular :
- the description as stated on www.freshfoodpoint.be of the product ordered
- the number of persons, date and time of pick-up or delivery
- the Consumer's contact details
- the name of the person for whom the order is intended
- in case of a business order, the correct invoicing details and an order reference enabling the administrative processing of the invoice within the requested payment period of 15 days from the invoice date.
Fresh Food Point.be reserves the right not to confirm an order for whatever reason, in particular a problem with the order received (e.g. unreadable document), an abnormal order, possible breakdowns or failures (e.g. at one of the respective internet providers through which the electronic data traffic passes) or an expected problem with the delivery to be made. - Fresh Food Point.be shall inform the consumer thereof insofar as it is in a position to do so. Fresh Food Point.be cannot be held liable for not receiving an order when the Consumer has not received a confirmation for whatever reason. Fresh Food Point.be will in such a case try as far as possible to find an alternative solution.
Fresh Food Point.be has the right to refuse a new order from the Consumer if amounts due in respect of previous orders have not been paid in time by the Consumer.
Article 5 - Availability of orders and terms of delivery
When placing his order, the Consumer must choose the place and date at which the merchandise will be made available.
Deliveries are mainly made by Het Waar Genoegen under its own management and this, barring exceptional arrangements, during normal office hours. The Consumer should choose the delivery address so that the delivery can be easily received. Deliveries should preferably be received on the ground floor. In the absence of a lift, Fresh Food Point.be may refuse delivery on a higher floor or charge extra delivery costs.
Fresh Food Point.be reserves the right to call on any logistics service provider at its discretion to deliver its products to the address indicated by the Consumer. Any exceptional additional costs resulting from this will be communicated to the Consumer prior to delivery.
The delivery costs for delivery within a radius of 5 km from the shop in Zaventem centre are €8.90 all-in for every shopping trolley worth less than €30 all-in (excluding delivery costs). The basic offer price refers to delivery at ground level. Generally, deliveries of orders under 30 € are not made, unless expressly agreed with the customer. For online orders below this amount, we will contact the customer to notify that the order will be ready for collection.
Deliveries are mainly carried out within a 5 km radius of the shop. Within this radius, deliveries are free of charge as from a minimum value (all-in, excluding delivery costs) of:
€50 for breakfast orders (time of delivery to be agreed) €30 for lunch orders (delivery between 10.30 a.m. and 12.30 p.m.) €50 for afternoon deliveries between 2 p.m. and 7 p.m., all-in (excluding delivery costs)
For all lunchdeliveries outside the 5 km radius of the shop, please find the minimum value below. All orders must be made according to the predefined criteria.

By placing an order, the Consumer undertakes to sign the delivery note presented by the delivery man, on which he may make any comments deemed necessary. By signing the order form, the Consumer confirms having received the number of parcels stated on it. If the consumer notices any damaged or missing products, he must lodge a complaint with Fresh Food Point.be within a maximum of 1 hour and do so by telephone with confirmation by e-mail, fax or post.
In all cases of force majeure, such as traffic jams, strikes, etc., as a result of which a delivery is delayed, prevented or impracticable, Fresh Food Point.be's obligations shall be cancelled without the consumer being able to claim compensation, even if the incident lasts longer than 1 day. In this hypothetical case, the consumer shall be fully and automatically released from his obligations regarding the order he has placed.
If possible, Fresh Food Point.be shall inform the consumer of the existence of such an incident as soon as possible and on the same day and by all appropriate means, in order to enable the latter to collect his order(s) as he wishes or to reply by e-mail or telephone to the notification to that effect. If the merchandise cannot be delivered to the Consumer through the fault or fault of the Consumer, the Consumer remains obliged to pay the full purchase price thereof.
Article 6 - Delivery periods
A delivery period has been determined for all products in the webshop. For all products that cannot be delivered on the same day, we ask the Consumer to order these products on a scheduled basis and no later than the specified number of days before the desired delivery date.
Delivery is made on the day of order for all food items that are in stock and for which the website does not provide a limitation of the order period (e.g. minimum 3 hours, 1 day or several days) or at the time (day and hour) communicated by the Consumer at the time of ordering. For larger orders (from 500 euros), the delivery period may vary from 1 day to a week after the order is placed, depending on the Consumer's request and the time Fresh Food Point.be needs to prepare the order. If an ordered item is not in stock at the time of the order or cannot be in stock for production by the requested delivery date and/or time, Fresh Food Point.bedit shall inform the Consumer as soon as reasonably possible and, if possible, Fresh Food Point.be shall propose a similar or equivalent other product.
If the Consumer is unable to take into account the possibility of scheduled ordering, he may contact Fresh Food Point.bedit by telephone to ascertain whether the desired product can still be delivered (usually the same day) before the desired time. In case of agreement by telephone, for smooth administration, the Consumer should forward a written confirmation of the off-line order by e-mail at orders@freshfoodpoint.be. Without this written confirmation, the off-line order will not be included in our planning. Depending on the complexity of the preparation of the order and the time needed to prepare it, a supplement may be charged of up to 20% of the basic price mentioned on www.freshfoodpoint.be.
Article 7 - Termination of the agreement and cancellation of the order
7.1. Due to the perishability of the daily fresh offer, the Consumer has no right to cancel the contract. Cancellation of the order by the Consumer is only possible if Fresh Food Point.be explicitly indicates that cancellation of the order by the Consumer is possible.
7.2. Valid cancellation free of charge is therefore only possible for scheduled orders communicated well in advance (at least 2 days). In this case, the Consumer can express his intention to cancel in writing (by e-mail) up to 24 hours before the time of delivery. If the order is cancelled less than 24 hours before the actual time of delivery, Freshfoodpoint.be has the right to charge up to 100% of the total amount. Freshfoodpoint.be has the right to refuse cancellations in whole or in part if the purchase or production of raw materials for the order has already started at the time of cancellation.
7.3. Freshfoodpoint.be has the right to cancel the order if, for example, there is force majeure, if the article or an important component is no longer available or if the consumer has provided an incorrect or inaccessible telephone number or delivery address.
7.4. If the Consumer places a false order (for example by failing to pay or by not being present at the delivery or pick-up location to receive the order) or otherwise fails to meet its obligations under the agreement, Freshfoodpoint.be may decide to refuse future orders from the Consumer concerned.
Freshfoodpoint.be has the right to refuse and cancel orders if there is reasonable doubt as to the correctness or authenticity of the order. If Freshfoodpoint.be cancels an order which has already been paid for, Freshfoodpoint.be will refund that amount to the same account from which payment was made. If the Consumer places demonstrably false or fraudulent orders, Freshfoodpoint.be may report this to the police.
Article 8 - Prices
All prices quoted are expressed in euros (€) and include VAT. The price charged to the Consumer is that which is stated when the Consumer confirms the order on the website www.freshfoodpoint.be. The products and services are paid by bank contact card on a secure website on our provider's server. The Consumer's payment or credit card is debited in euros (€) two days after acceptance of the order by De Laere BVBA. Fresh Food Point.retains ownership of the product(s) until such time as the Consumer has paid the price for the product(s) and services in full and the ordered products have been delivered to the Consumer.
All prices stated are indicative. The price charged is the price applicable on the day of the offer and reflected on the website www.freshfoodpoint.be. The price charged is also stated on the accompanying document of the goods. The prices mentioned in the printed and/or .pdf brochures may change due to changes in the market situation, changes in VAT, excise, customs and/or other legally imposed rates and/or prices, ecotax, raw material exchange rate, packaging costs or correction of possible printing errors.
For the products for which no price is mentioned on the website, the day price of the day on which the offer is foreseen applies. The stated price only relates to the article as it is described verbatim, the accompanying photo is illustrative and the Consumer cannot derive any rights from it.
Article 9 - Product information
The photos illustrating the products are for information purposes only. The accompanying text of these photos is a description of the goods. Any differences between the photos and the products only concern deviations o.w.v. the fresh nature of the goods and do not relate to essential quality differences. The colour of the food products depicted in the online shop may differ from the actual colour.
Article 10 - Terms of payment
All orders via www.freshfoodpoint.be must be paid in cash using the online payment module. Any offline handling of payment by bank transfer of the amount stated on the invoice must be discussed explicitly and prior to delivery of the order with Fres Food Point.be. Payment by bank transfer will then be activated as a payment method under strict conditions. Fresh Food Point.be applies a payment term of 15 days after the invoice date.
If any outstanding amount is not paid on time or in full, without prior notice of default being required, the outstanding principal sum shall automatically be increased by a fixed compensation of 15% of the outstanding debt, with a minimum of EUR 25.00. In addition, a default interest of 12% shall be applied to the outstanding amount by operation of law and without notice of default until payment in full. Outstanding invoices may be collected via an external partner if the payment term is exceeded by 30 days from the invoice date, which will give rise to an additional administrative cost of EUR 10.00 per collection.
In the event of late payment, Fresh Food Point.be has the right to suspend deliveries to the Consumer concerned immediately, unilaterally and without warning. Furthermore, as from the first late payment, Fresh Food Point.be may demand payment of any not yet due invoice from the Consumer concerned. When a member of staff who orders via the on-line ordering platform of www.freshfoodpoint for companies, fails to pay his monthly bill or leaves the company with an outstanding bill, his employer becomes liable for collecting and forwarding the amount due.
Fresh Food Point.be, sends all invoices by electronic means, unless the Consumer has expressly indicated that he does not wish this. The Consumer agrees to conduct all communication with Fresh Food Point.be and its appointees by digital communication (e-mail or GSM).
Article 11 - Privacy protection
Fresh Food Point.be is committed to protecting your privacy. Fresh Food Point.be is protected by the SSL certificate. All personal data collected when you register on our sales site are used solely to process your order and to inform you of new products and services if you so wish. Fresh Food Point.be undertakes not to sell, rent or disclose your personal data to anyone (and in particular to third parties). Fresh Food Point.be collects only those data necessary to ensure proper service. (address, first name, name, linked company, billing details, telephone number, fax number, email, language, age, delivery address, orders). You can consult, modify or delete your personal data at any time in the customer portal.
Article 12 - Information required
By placing an order on the www.freshfoodpoint.be sales site, you consent to the use by Fresh Food Point.be of the personal data concerning you which you have communicated or which are collected when you navigate on the website. We need this information (name, e-mail address, postal address, credit card number and expiry date, etc.) in order to process your orders.
Article 13 - Protection of personal data
Orders (including information about your account) are sent via a secure server. All data you communicate to us are encrypted by security software (SSL) before being sent to us. Furthermore, all exchanged messages are protected against unauthorised access by third parties.
Article 14 - Guarantee
The Consumer is entitled to the legal guarantee against hidden defects on the products sold. All our products are composed and prepared with the utmost care. However, there is no obligation to guarantee in case of faults, damage due to careless handling after receipt of the goods. The buyer should keep the goods refrigerated if the product is not consumed within the hour after delivery. In case of exceptional summer temperatures (above 25°), it is necessary to put the delivered goods in a cooler immediately in order to guarantee freshness after delivery. In any event, the delivered products must be consumed within a period of 2 to 3 hours.
Article 15 - Complaints
Any complaints regarding the service provided and the condition of the fresh goods must be reported to Fresh Food Point no later than 1 hour after the delivery of the purchase.under penalty of forfeiture of all rights.
Fresh Food Point.be shall not be liable for damage caused by the consumer or a third party after delivery, nor for indirect damage such as, for example, failure to keep goods cool after delivery, theft, etc.
Article 16- Intellectual property
By logging on to the website www.freshfoodpoint which was developed by De Laere BVBA, holder of all associated intellectual property rights, the Consumer undertakes not to copy or download all or part of its content, unless Fresh Food Point.be has given him express prior consent to do so.
Article 17 - Proof
The Consumer accepts that electronic communications and backups may serve as evidence.
Article 18 - Applicable law - Competent court
Belgian law is applicable, In the event of any disputes, the courts of Brussels have exclusive jurisdiction.
